What is the current MOA Notification Code?
- In a nutshell it is that any outdoor application of a pesticide by spraying, in the Municipality requires some method of notification. This means Prior notification and a mandatory wait time of 48 hours along with an additional 48 hours of post-application notification. Here is how it works:
All properties that join by touching the home or business where the chemical is to be applied OR that is directly across a residential street or alley (or stream) must receive a notice of application no less than 48 hours (and no more than 120 hours) prior to the service. In additon, a notice must be affixed to the location being serviced during that same window AND remain in place for 48 hours after the service is performed.
EXCEPTION #1: If no "adjoining or adjacent" property line is within 150 feet of the location (tree, shrub etc) to be sprayed, no pre-notification is required, and only the property being serviced must receive a notice, to be affixed at the time of service and left in place for 48 hours after the job is completed (thus eliminating the 48 hour waiting period).
EXCEPTION #2: If the application is being made to a "structure" (building, shed, deck, retaining wall, decorative logs etc.), or within 3 feet of the "structure", the previous exception applies with the distance reduced to 30 feet.
EXCEPTION TO THE EXCEPTIONS (You have to love politicians): If the property receiving service is occupied by a tenant OR TENANTS, and it was not they who arranged the service, while the "adjoining or adjacent" properties would not require it, each tenant must receive the 48/120 hour notification. In this case, however, it is the responsibility of the owner/manager of the property to do the notifying.
